7. AI-Generated Content

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARIOME ANALYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or research results
  • Business interruption
  • Costs of substitute services
  • Any damages arising from your use or inability to use the Service

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Termination

13.1 Termination by You

We may suspend or terminate your account immediately if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete Your Data within 30 days of termination. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnification, and limitations of liability.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
